Image Files and Album Details

Any image files included with the package will be delivered with final album only. There are no exceptions.
Image files will be stored with weddings and Media for a maximum of four months.

Once album(s) is/are ordered, the Album and Slideshow sites will remain online for at least 1 month. Images for albums must be chosen within a 1 month period.

The total price of the album(s) will be discounted whatever album credit is included in the package. Album credit does not carry a monetary value beyond the credit toward the album price. Any extra credit is non-refundable.

Minimum turnaround time for the final image product is 4 months. We will make every possible effort to complete your wedding photos prior to this time period.

Terms and Conditions

Client (hereinafter known as Contracting Party): Jon Smith

Sales tax is required on the full package price on any package where there are any tangible goods and is based on tax rate for the address that those goods are delivered to. To secure your date, a non-refundable date reservation fee of 50% of the package price is due at the signing of this agreement with the balance due 30 days prior to the wedding day.

Additional Travel expenses agreed to: All travel and lodging expenses are in addition to the package prices. Contracting Party agrees to cover all travel related expenses as well as lodging for all nights required for Videographer and his assistant to shoot, including the night before and after the event. Separate rooms are required unless otherwise agreed to in writing by Photographer.

This agreement constitutes an order for wedding photography services, including the taking of wedding videos as agreed to by both parties-photographer (Weddings and Media, hereinafter known as the photographer), and Contracting Party-and the provision to Contracting Party of online proofs in digital form and copies of high resolution files of all final digital assets. It is understood nonetheless that any and all proofs, digital files, sample DVDs or BLURAYs, final or sample and all rights to them remain the sole and exclusive property of the photographer and may be used for publication, advertising, display, or any other purpose thought proper by the photographer pursuant to this agreement and the Contracting Party hereby agrees and consents to the same. This agreement qualifies as a model and/or property release.

The Contracting Party hereby shall be permitted the right to order prints and use such materials at the agreed-to prevailing rates. The Photographer owns all copyrights. This contract assigns usage and reproduction rights. The photographer has no legal responsibility to retain a copy of these files beyond final delivery.

There shall be no refund of date reservation fees, deposits or retainers paid if the event is cancelled in any way. The full and complete sum shall be deemed due upon deliver of final product.

All proofs will be provided for viewing in digital form unless otherwise stated.

If the Contracting Party hereby fails to make whatever payments are required under this agreement, then all obligations of the photographer shall cease without any further obligations thereto the Contracting Party.

In the unlikely event that the photographer is injured or becomes ill or in any way cannot follow through on this contract or for whatever reason is unable to photograph the event, the photographer will make every effort to secure a replacement photographer. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event package. Legally, there shall be no liability on behalf of the photographer, it’s employees, agents, assigns or licensees for their non-performance caused by any force major or similar circumstances, illness, accident, act of God, act of terrorism or any cause beyond their control; nor for the loss or damage of any video materials, whether in transit or in due to mechanical failure. In any event, the limit of the photographer liability shall not exceed the contract price stated herein. That said, the photographer will make every reasonable effort to remedy any problems that present themselves. The Contracting Party hereby releases, discharges and agrees to save harmless the photographer, its heirs, legal representatives, assigns, employees or any persons or corporations acting under permission or authority from the photographer from and against any liability as a result of any distortion, blurring or alteration, optical illusion or use in composite form, either intentionally or otherwise, that may occur or be produced in the taking, processing or reproduction of the video. Although all care will be taken with digital files and the videos taken at the wedding, the photographer limits any liability for loss, damage, injury, death, or failure to deliver videos for any reason to the return of the contract fees stated herein.

There are no oral or other agreements the parties hereto and this agreement constitutes full and complete agreement between the parties. Changes must be submitted in writing and signed by both parties.

There shall be no refunds. Substitutions may be welcome.

Due to the uncontrollable nature of wedding logistics, photography on requests may be impossible. While every effort will be made, no requests are guaranteed and the photographer assumes no liability for omissions.

This agreement is not to be construed as an employment agreement in any way. The photographer function is that of an independent contractor providing video services.

On signing of this agreement by both parties hereto and after receiving the date reservation fee, the photographer will reserve the date and times agreed upon and will not make another reservation for that specific date. For this reason, all reservation fees are non-refundable even if the date is changed or if the wedding is cancelled for any reason.

The photographer asks that a courtesy meal be provided for the photographer(s) . If a meal is not provided, then the photographer(s) may leave your reception for up to 45 minutes. (Note: Weddings & Media is not responsible for any event not captured in the case that one or more of the photographer must leave the reception to obtain a meal.)

I, the undersigned Contracting Party, hereby warrant that I am competent to contract in my own name. I confirm that I have read the herein agreement prior to its execution and I am fully familiar with the contents thereof. This agreement shall be binding upon me and my heirs, legal representatives and assigns.
